1. Learned counsel for the petitioner would submit that the petitioner appeared in a limited competitive examination for promotion to the post of Assistant Manager in the Industrial Department. In which, out of 50 marks, he has secured 21 marks, which makes it to 42%. It is stated in general for promotion 50 % marks are required which is 25 marks out of 50 marks. It is contended the relaxation is given to the Schedule Caste/ Schedule Tribe of 10 % so cut off qualifying marks for Schedule Caste/ Schedule Tribe would be 40%. The petitioner contends he secured 21 marks which would make it more than 40%.
He submits that the representation of the petitioner is filed to reconsider the case of the petitioner which is pending adjudication at the end of Directorate of Industries (C.G.) (Respondent No.3) that may be directed to be decided.
2. Considering the nature of dispute and prayer made by petitioner to decide the representation without any observation on the merits of the case the petitioner is directed to file a fresh representation to Respondent No.3 within two weeks from the date of receipt of copy of this order which may be decided within further period of 45 days.
