----Respondents For Petitioner :
Mr. Jameel Akhtar Lohani, Advocate For State :
Ms. Sunita Jain, Panel Lawyer Hon'ble Shri Justice P. Sam Koshy Order on Board 27/10/2018
1. The challenge in the present writ petition is to the order dated 06.10.2018, whereby the authority concerned i.e. the respondent No.3 has ordered for relieving of the petitioner to be posted as has been envisaged in the order of transfer dated 17.01.2018.
2. Perusal of the record shows that the petitioner has not challenged the original order of transfer dated 17.01.2018, but has only challenged the present order dated 05.10.2018, which is an order of relieving. This Court therefore does not find any strong case for interfering with the said impugned order.
3. At this juncture, the counsel for the petitioner submits that the petitioner has already been assigned the election duties and in
support of that the petitioner has produced the Annexure P/7, which is a document, which shows that the petitioner has been assigned the election duties.
4. Given the facts and taking note of the instructions issued by the Election Commission of India as also the instructions issued by the Government of Chhattisgarh, it is ordered that the effect and operation of the impugned order dated 05.10.2018 shall remain stayed till the conclusion of the election duties and thereafter appropriate orders would be passed for relieving the petitioner in accordance with the order dated 17.01.2018.
5. With the aforesaid observations, the present writ petition stands disposed off.
