2. The present MCC is preferred for recalling of the order dated 24.9.2018 passed by this Court in WP No.1348 of 2004 and for its restoration.

3. The aforesaid writ petition was taken up for hearing on

24.9.2018, but since none appeared on behalf of the applicant/petitioner on the said date, this Court, after due consideration of the facts, dismissed the writ petition, which was filed way back in the year 2004, as having rendered infructuous.

4. Learned counsel for the applicant would submit that the applicant is an old aged retired citizen and his only source of income is his pension, therefore, the writ petition may be restored and it may be heard on merits.
