(1) This petition has been filed by the petitioner for extension of time of the bail period to him up to 15th July, 2017. This Court, initially, by order dated 04.01.2017 passed in M.Cr.C. No.7437/2016 granted bail to the petitioner for a period of one month from 07.01. 2017. Again the bail period was extended up to 17.03.2017 by this Court vide order dated 10.02.2017.
(2) Counsel for the petitioner submits that the petitioner is still undergoing treatment in the AIIMS Hospital, New Delhi and, therefore, the bail period granted by this Court may be extended up to 15th July, 2017 for further evaluation and the surgical intervention, if any.
(3) On the other hand, counsel for the State, on verification, submits that the petitioner is still undergoing treatment at AIIMS, New Delhi for treatment. He submits that initially petitioner has been granted bail by this Court on 04.01.2017 passed in M.Cr.C. No.7437/2016. - (4) After hearing learned counsel for the parties and considering the medical condition of the petitioner; and the documents filed by the parties; and the fact that petitioner is still undergoing treatment at AIIMS, New Delhi, I deem it appropriate to extend the bail period of the petitioner till 15th July, 2017. Order accordingly. (5) Now the petitioner shall surrender before the learned trial Judge on 17th July, 2017. Learned trial Judge shall inform the Registry of this Court about the surrender of the petitioner.
(6) However, learned counsel for the petitioner submits that the petitioner has instructed his counsel about the continuance trial, and therefore, the trial Court may continue with the trial and it not be adjourned.
(7) This Statement is taken on record.
(8) Copy of this order be sent to the trial Court to proceed with the trial.
(9) With the aforesaid observation, the criminal misc. petition stand finally disposed of.
