Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 23/03/2017 Heard.

1. This is the second bail application. The earlier application for grant of bail moved by the applicant was rejected by this Court on 24.10.2016.

2. The applicant has been arrested in connection with Crime No.507 of 2016 registered in Police Station- Supela, District- Durg (C.G.) for alleged commission of offence under Sections 342, 363, 366, 323 IPC and Sections 11(1) & 12 of the Protection of Children from Sexual Offences Act, 2012.

3. This application has been filed by the applicant on the ground that the prosecutrix has been examined and what she has deposed in the Court does not inspire confidence. There are contradictions and omissions in her statement and as regards to the age of the prosecutrix also, there is no clinching evidence of the prosecution led before the Court that the prosecutrix, at the time of alleged commission of offence, was less than 18 years of age.

4. This Court has also considered the application on merits. Therefore, in these

-2circumstances, I am not inclined to grant bail to the applicant.

5. The application is therefore rejected.
