Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 19/05/2017 Heard.

1. This is the third application for grant of bail to the applicant.

2. The applicant has been arrested in connection with Crime No.100 of 2016 registered in Police Station- Khamtarai, Raipur (C.G.) for alleged commission of offence under Section 376 IPC and Section 6 of the Protection of Children from Sexual Offences Act, 2012.

3. This third bail application has been moved by the applicant mainly on the ground of delay in trial. It is submitted that the applicant is in jail since 9.6.2016 but till date, the trial has not been concluded. Therefore, only on this ground, applicant may be considered for grant of bail.

4. Learned counsel for the State, however, opposes the application and submits that it being a case of commission of heinous offence and earlier application having been rejected on merits, the applicant is not entitled for grant of bail.

Considering the submissions made by learned counsel for the parties and the period of detention of the applicant, at this stage, I am not inclined to grant bail only on the ground of delay in trial. However, the trial Court is directed to expedite the trial and conclude the same as early as possible.

6. In case the trial is not concluded within a reasonable time, the applicant may revive the application.

7. The application is accordingly rejected.
