Hon'ble Shri Justice Goutam Bhaduri Order on Board 07.04.2017

1. This is third bail application filed under Section 439 of the Code of Criminal Procedure seeking grant of regular bail to the applicant in connection with Crime No. 246/2015 registered at P.S. Lormi, Distt. Mungeli (C.G) for the offence punishable under Sections 304-B/34 of IPC. The first bail application was dismissed on 30.11.2015 on merits. The second one was dismissed as withdrawn on 21.3.2016

2. As per the prosecution case, deceased Vimla Bai committed suicide by hanging herself within 7 months of the marriage. It is contended that the specific demand of money was made by the applicant and it was not fulfilled by the deceased and on the basis of which when the torture became unbearable she had committed suicide on 05.05.2015. Subsequently, on the complaint the present applicant has been arrested on 29.05.2015.

3. Learned counsel for the applicant would submit that there is no progress in trial and the witnesses are not turning up, therefore, the applicant may be enlarged on bail.

4. Per contra, learned State Counsel opposes the prayer.

5. Perused the earlier order dated 30.11.2015 whereby the first bail

application was dismissed. Considering the same I am not inclined to go into the merits of the case. Accordingly, this bail application is rejected.

6. However, in the facts and circumstances of the case, the trial Court is requested to expedite the trial.
