This is the third bail application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant who has been arrested in connection with Crime No.65/2016 registered at Police Station- Anda, District Durg (C.G.) for the offence punishable under Section 363, 366(A) & 370 of Indian Penal Code & Section 3 & 4 of Protection of Children from Sexual Offences Act. The first bail application was dismissed on merit on 17.08.2016 and thereafter the second bail application was dismissed on 09.11.2016.

Case of the prosecution, in brief, is that on 07.06.2016 a report was made by the complainant Suresh Kumar Dilliwar, father of the prosecutrix, that his minor daughter was missing from 05.06.2016. Subsequently, his daughter was recovered from the possession of the applicant and it was found that she being a minor girl was used by the present applicant for prostitution and human trafficking and thereby the aforesaid offence was committed.

Learned counsel for the applicant submits that the applicant has been falsely implicated and she is in jail since 16.07.2016, therefore, she may be released on bail. He further submits that considering the facts of this case, the Trial Court may be directed to expedite the trial.

Per contra, learned State counsel opposes the prayer for grant of bail.

Considering the facts of this case as also the earlier dismissal orders, I do not find any change of circumstances to reconsider the instant third bail application.

Accordingly, the bail application is dismissed at the admission stage itself. However, the Trial Court is directed to expedite the trial. Ashok Sd/- (Goutam Bhaduri) Judge
