This is the second bail application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant who has been arrested in connection with Crime No.422/2016 registered at Police Station- Arang, Distt. Raipur (C.G.) for the offence punishable under Section 34(2) of the Excise Act. The earlier bail application was dismissed as withdrawn on 21.12.2016 with liberty to repeat the same after examination of the seizure witnesses.

On having been specifically asked to the learned counsel for the applicant whether the seizure witnesses have been examined or not, he is not able to make any submission.

In view of this, I do not find any change of circumstances to reconsider the instant second bail application. 4.
Accordingly, the bail application is dismissed at the admission stage itself. However, the Trial Court is requested to expedite the trial. Ashok Sd/- (Goutam Bhaduri) Judge
