This is second bail application under Section 439 of Cr.P.C. The earlier bail application was dismissed as withdrawn on 10/11/2016 vide M.Cr.C. No.7013 of 2016.

The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No. 291/2016 registered in Police Station City Kotwali, Raigarh District Raigarh (C.G.) for offence punishable under sections 489 (A), (B), (C) r/w 34 of Indian Penal Code. 3.
Learned counsel for the applicant submits that the applicant is in jail since 16/05/2016, charge sheet has been filed and he is suffering from ailment of liver and arthritis, therefore the applicant may be released on bail.

Learned State counsel opposes the prayer for grant of bail 5.
The earlier bail application was dismissed on 10/11/2016. The order would show that no liberty was given to repeat the bail application, however direction was given to the trial court to expedite the trial. In view
of the fact that no liberty was given and it was simplicitor withdrawal was made, there is no change of circumstance appears to entertain this second bail application.

Accordingly, the second bail application is dismissed. It is further directed that the applicant as appears has been said to be ailing, therefore proper medical care may be given to the applicant. Sd/- (Goutam Bhaduri) JUDGE gouri
