At the outset, learned counsel for the applicant would submit that this is a repeat bail application under the head 'MCRC(A)' as the first MCRCA No.1387/2016 was dismissed on merits after due hearing on 29.3.2017.

Learned counsel submits that the applicant intends to surrender before the authorities and intends to file application under Section 437 Cr.P.C. before the concerned criminal court and the court below be directed to dispose of the application on the same day.

As prayed, the instant MCRCA is disposed of as withdrawn. The applicant may surrender before the authorities and the court concerned, if the application is filed under Section 437 Cr.P.C., is directed to hear and dispose of the application as expeditiously as possible, if possible on the same day. The applicant may also give 3 days prior notice to the concerned IO/SHO Kurud, district Dhamtari (CG) for his filing the application under Section 437 Cr.P.C. before the concerned criminal court so as to enable the concerned police station to submit the case diary, perform other procedural acts as required and present the facts in the hearing. 4.
