The applicant has preferred this application filed under Section 439 of the Cr.P.C. for grant of regular bail as he is arrested in connection with crime No.113/2010 registered in Police Station Jhagrakhand, District Koriya (CG) for the offence punishable under Sections 363, 366, 376 & 493 of the Indian Penal Code.

Although the applicant was released on bail vide order dated 29-8-2011 passed in M.Cr.C.No.2529 of 2011, however, in
course of trial the applicant remained absent for which warrant of arrest was issued against him in execution of which he could be arrested after five years.

Learned counsel appearing for the applicant would inform that one more crime was registered against the applicant in the year 2009.

Learned counsel appearing for the applicant is possessed of the statement of the prosecutrix. This Court has gone through the said statement.

Considering the entire facts and circumstances of the case and particularly considering the absence of the applicant before the trial Court for a long period of 5 years, I am not inclined to release the applicant on bail.

Accordingly, the bail application is rejected. Let the trial be completed expeditiously preferably within a period of six months.
