The instant Cr.M.P is admitted for consideration. 3.

Heard the matter finally.

Learned Counsel for the petitioner would submit that as the respondent No.2 was not represented in the CRMP No. 52/16 on 22/03/2016, present matter may be disposed of without even noticing to respondent No.02.

On due consideration, instant CRMP is hereby allowed and as submitted that the petitioner shall remove the default within 2 weeks from now, in CRMP No. 52/16 which was dismissed on a peremptory order dated 22/03/2016, may be restored.

On due consideration of above submission, the instant CRMP is allowed with a direction that if the petitioner removes the default within 2 weeks from today in CRMP No. 52/16 then only the said CRMP be restored to its original number.
