The applicant has been arrested in connection with Crime No.345/2016 registered at Police Station -Simga, District - Baloda Bazar - Bhatapara (CG) for alleged commission of offences under Section 366 (A), 376, 506 of IPC and Section 4 of the Protection of Children from Sexual Offences Act, 2012. 2.

The case of the prosecution is that the applicant committed rape on the prosecutrix.

Learned counsel for the applicant submits that the prosecutrix has now been examined in the Court and her statement does not inspire confidence and suffers from inherent contradictions and omissions. He submits that the prosecutrix appears to be tutored witness.

State counsel opposes bail application.

Without commenting upon the merits of the case, taking into consideration the totality of the circumstances, I am not inclined to grant bail to the applicant. The application is therefore rejected.
