The petitioner by an order dated 25.06.2015 in Cr.M.P. No.458 of 2015 was allowed to go abroad for a period of six months with a cut off date 30.04.2017 on furnishing a bond in sum of Rs.5 Lakhs and further surety of Rs. 5 Lakhs. Now the petition has been filed with a prayer that the petitioner has been officially allowed to go United States of America on 21.04.2017 and the VISA has been allowed with a cut off date 19.12.2019.

It is submitted that the schedule of the petitioner to go USA is on 21.04.2017, therefore, the time granted in Cr.M.P. No.458 of 2015 for the period of six months may be extended as in earlier occasion he was not able to go for official reasons and clearance; therefore the time may be further extended with the same condition.

Perused the VISA and the Notice (Annexure P-3) and the earlier order. In view of the facts and circumstances, it is ordered that the petitioner will be allowed to go abroad for a period of 6 1⁄2 months from 21.04.2017. It is further made clear that no adjournment shall be taken before the Court below during the hearing of case on the ground that the petitioner is absent.

With such observation, the petition stands disposed off. 5.
