This is 5th bail application.

Explanation has been received from the concerned Court. It is on record that 22 witnesses have already been examined and only one witness i.e. investigating officer Mr.F. Kerketta is left to be examined and case is fixed for examination of the said investigating officer on 1st July, 2017. 3.

Learned counsel for the applicant would submit that despite warrant of arrest, the investigating officer is not appearing. 4.

Learned State Counsel would submit that on the next date of hearing the Investigating officer Mr.F. Kerketta will be produced and he will be examined.

The Superintendent of Police, Korea is directed to ensure the presence of Mr.F. Kerketta, Investigating Officer, before the said Court on 1st

July, 2017 and he will be examined on the day positively. The trial Court would decide the case finally on or before 20th July, 2017. 6.

A copy of this order be sent to the Director General of Police, Raipur to see as to why Mr.F. Kerketta, investigating officer, has not appeared despite the order of that Court for examination and to ensure that investigating officer should promptly appear on the date before the Courts for their examination without waiting for issuance of bailable warrant/non-bailable warrant as it is informed by counsel for the applicant that non-bailable warrant has been issued against the investigating officer Mr.F. Kerketta. 7.

With the aforesaid observation, the bail application stands disposed of.
