Justice Rajani Dubey Order on Board 06/12/2019 • The accused/applicants have moved this first bail application under Section 439 of Criminal Procedure Code for releasing them on regular bail during trial in connection with Crime No. 175/2019 registered at Police Station Nagarnar, District Bastar (C.G.) for the offence punishable under Section 379/34 of IPC. • The prosecution story, in brief is that it has been alleged that the applicants had stolen 24 set of batteries of worth Rs. 2,00,000/-. On the basis of said facts, offence has been registered against the applicants and they have been arrested.

• Learned counsel for the applicants submits that the applicants have been falsely implicated in the crime in question. He further submits that they are in jail since 24.07.2019 and they are ready to furnish adequate surety and shall abide by all the directions and conditions, which may be imposed upon them, therefore, they may be released

on bail.

• On the other hand, counsel for the State opposes the bail application. • I have heard learned Counsel for the parties. • Taking into consideration the nature and gravity of the offence, detention period of the applicants facts and circumstances of the case, the fact that charge-sheet has been filed and the trial is likely to take some time for final disposal, I am inclined to release applicants on bail.

• It is directed that the applicants shall be released on bail on executing a personal bond for a sum of Rs. 1,00,000/- each, with one local surety for the like amount to the satisfaction of the Trial Court for their appearance before the said Court as and when directed.
