1. The challenge in the present writ petition is to the order of transfer Annexure P-1 dated 23.08.2019 whereby the petitioner has been transferred from District Hospital Ambikapur District Surguja to Primary Health Centre Maharajganj, District Balrampur.
2. Contention of the petitioner is that the petitioner is the District Secretary of the Chhattisgarh Tritiya Varga Shaskiya Karmachari Sangh and therefore he falls within the protected category and under the transfer policy of the State Government, he could not have been transferred.
3. Given the said facts, let petitioner make a detailed representation to the respondent No.1 within a period of 10 days from the date of receipt of copy of this order and respondent No.1 in turn shall decide the same within a further period of 45 days subject to the verification of the protection given to the petitioner as office bearer.
4. Till the representation of the petitioner is decided, the effect and operation of the impugned order shall remain stayed so far as the petitioner is concerned.
