2. The applicant has preferred this application for grant of bail as he is arrested on 20-12-2016 in connection with Crime No. 58/2016 registered in PS Kunda, Distt. Kabirdham (CG) for offence punishable under Section 302/34 of the Indian Penal Code.
3. This is a repeat bail application. Earlier MCRC No. 2117/2017 was dismissed after consideration of merit on 12-4-2017.
4. Learned counsel for the applicant submits that presently the matter is pending as Sessions Trial No. 5/2017 before the Sessions Judge, Kabirdham. The applicant is innocent, falsely implicated. He is aged about 34 years. Trial may take some time. Therefore, the applicant may be enlarged on bail.
5. Per contra, learned State counsel opposed the arguments advanced on behalf of the applicant and submits that earlier the prayer for grant of bail was dismissed by this court after due appreciation.
6. Perused the entire material.
7. As the applicant's application for grant of bail has been dismissed
after due consideration by this Court as aforementioned and there is no change in the circumstances, I do not find the present as fit case for grant of bail to the applicant.
8. The instant MCRC is dismissed.
