Apprehending arrest in connection with Crime No.251/2016 registered at Police Station- City Kotwali, Raigarh, District Raigarh (C.G.) for the offence punishable under Section 409, 420/34, 120(B) of Indian Penal Code and 13(2), 13(1)(d) of Prevention of Corruption Act, the applicant has preferred this application under Section 438 of the Code of Criminal Procedure for grant of anticipatory bail.

This is the second anticipatory bail application. The first anticipatory bail application was dismissed as withdrawn on 25.01.2017 with liberty to the applicant that he may surrender before the trial Court and file an application for regular bail, but again the second anticipatory bail application is filed.

It has been stated by the learned counsel for the applicant that the applicant has not surrendered before the Court below and do not apply for regular bail. No convincing reason is assigned that how such order dated 25.01.2017 is not complied with. Consequently, I do not find any reason to reconsider the instant second anticipatory bail application.

Accordingly, the bail application filed under Section 438 of Cr.P.C. is dismissed.
