Order On Board 31/10/2018

1. This is the first bail application filed under Section 439 of the Code of Criminal Procedure for grant of bail to the applicant who has been arrested in connection with Crime No. 370/2018 registered at Police Station- City Kotwali, District Bilaspur (C.G.) for the offence punishable under Section 21 and 22 NDPS Act.

2. As per prosecution case is that 7200 tablets of Nitra Keet 10 were recovered from the possession of the applicant.

3. Learned counsel for the applicant submits that the applicant has not committed any offence and has been implicated in a false case. He submits that as he is in jail since 22.08.2018, he may be released on bail.

4. Per contra, learned State counsel opposes the prayer for grant of bail.

5. Considering the facts and circumstances of the case and that fact that a huge quantity of 7200 Nitra Keet 10 sleep inducing tablets has been seized from the possession of the applicant, I am not inclined to release the applicant on bail. Accordingly, the bail application is rejected.
