Heard on the application filed under Section 439 of the Cr.P.C. This is first bail application before this Court filed by the applicant for grant of regular bail. The applicant has been arrested on 08-08-2018 in connection with Crime No.175/2018 registered at P.S. - Jarhagaon, Distt. Mungeli, Chhattisgarh for the offence under Section 363, 366, 342, 506B of the IPC & Section 8 of POCSO Act.

It is submitted on behalf of the applicant that the applicant has been falsely implicated in this case. He is in jail since 08-08-2018. No case is made out against this applicant. Charge sheet has been filed after completion of the investigation. Therefore, it is prayed that the applicant may be granted regular bail.

Learned counsel for the State/non-applicant opposes the application. 4.

The prosecutrix is 14 years old girl who has stated that on the date of incident when she was on her way to home on her cycle she met with this applicant who caught hold of her hand and by force made her to sit on his motorcycle and took her to the place of his sister and brother-in-law.

Heard learned counsel for the parties and perused the case diary. 6.

After considering on the material present in the case diary and for the reason that now the charge sheet has been filed before the concerned Court, I feel inclined to allow this application.

Consequently, this application filed by the applicant under Section 439 of the Cr.P.C. for grant of regular bail is hereby allowed. It is directed that the applicant shall be released on bail on his furnishing a personal bond in the sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the concerned Court, for his appearance as and when directed. 8.
