24.02.2021 Heard on application for condonation of delay and application for grant of leave to appeal.
Upon due consideration, application for condonation of delay is allowed.
Taking into consideration the submission of learned State counsel that the acquittal has been ordered by the Court below without considering that the medical examination has taken place on 06.06.2014 which was after 8 months of the incident of murder and no family member has stated regarding mental sickness of the accused, we are inclined to grant to leave to appeal.
Let the appeal filed by the State be registered as Acquittal Appeal and be listed for further orders.
CRMP is accordingly disposed off.
