The applicant has moved this application under Section 439 of the Cr.P.C. for grant of regular bail in connection with Crime No.380/2016 registered at Police Station Masturi, District Bilaspur for the offence punishable under Section 342, 34 of IPC and Section 11 & 12 of the Protection of Children from Sexual Offences Act, 2012. The applicant has been arrested on 03-10-2016.

This is a second application for grant of bail. First application was rejected on merits. The grounds urged in the application would show that the main ground for repeating bail application is that the applicant is in jail since 03-10-2016 and the trial has not been concluded. 4.

Taking into consideration the nature of allegation and that earlier

application was rejected by this Court on merits, I am not inclined to grant bail to the applicant only on the ground that the applicant is in jail since 03-10-2016. 5.

In the result, the application is rejected. However, the trial Court is directed to expedite the trial and conclude the same as early as possible without granting unnecessary adjournment to any of the parties. SD/- ( Manindra Mohan Shrivastava) J U D G E Tumane
