This is second bail application under Section 439 of Cr.P.C. The first bail application was dismissed on 20/09/2016 vide M.Cr.C. No.5667/2016.

The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.231/2016 registered in Police Station Palari, District Balodabazar-Bhatapara (CG) for offence punishable under section 363, 366, 376 of Indian Penal Code and Section 4 of the Protection of Children from Sexual Offences Act 2012. 3.
As per the prosecution case, a report was lodged by Budhyarin Banjare that the applicant has enticed the minor girl and took her away from the lawful custody of parents on the pretext of marriage and thereafter committed forcible sexual intercourse. Subsequently, the girl was recovered from the possession of the applicant on 11/06/2016 and on enquiry it was revealed that the applicant allured and took away the girl and established physical relations, thereby the offence is committed.

Learned counsel for the applicant submits that the applicant has been falsely implicated in the case, therefore he may be enlarged on bail. 5.
Learned State counsel opposes the prayer for grant of bail. 6.
Perusal of the order would show that rejection was made on merits. No change of circumstances has been pointed out by the applicant so as to reconsider this second bail application. Consequently, I do not find any ground to reconsider this second bail application. 7.
