Mr. Suryakant Pandey, Panel Lawyer, for the State. This is second bail application filed by the applicant for grant of bail relating to Crime No.13 of 2016 registered at Police Station Narayanpur, Distt. Narayanpur (C.G) for the offence punishable u/ss 306 & 376 IPC.

The first bail application was dismissed on merits on 20.07.2016.

As per the prosecution case, the applicant was in love relation with deceased, thereafter on the pretext of marriage the applicant sexually exploited the girl and ultimately the applicant refused to marry her which led her to commit suicide in the intervening night of 31.01.2016 and 01.02.2016, thereby the aforesaid offence was committed.

Learned counsel for the applicant submits that there is considerable delay in progress of trial and since the applicant is in jail since 09.02.2016, looking to the period of his detention, he may be released on bail. Perused the earlier bail rejection order dated

09.2.2016 which was dismissed on merits.

Taking into nature of allegations levelled against the applicant and considering the earlier bail rejection, I do not find any change of circumstances to reconsider the bail at this stage. Accordingly, the application is rejected. However, the trial Court is requested to expedite the trial.
