This is the second application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant, who has been arrested in connection with Crime No.159/2017, registered at Police Station City Kotwali, District Baloda Bazar-Bhatapara (CG) for the offence punishable under Sections 302/34, 294 and 506 of IPC. 3.

The first bail application was dismissed by a detailed order. 4.

In subsequent bail application, this Court is not entitled to evaluate and appreciate the evidence led by the prosecution so far during the course of trial.
