The applicant has preferred this second Bail Application under Section 439 of the Code of Criminal Procedure, 1973 in connection with Crime No. 293/2021 registered at Police Station- Khursipar, Distt. Durg for the offence punishable under Section 399 of the IPC and Section 25 of the Arms Act. 2.
I.A. No. 01/2021, application for grant of ad-interim bail application has also been filed on the ground that father of applicant Late Archie Bold Morish had died on 11/11/2021 and his condolence is going to be scheduled from 16/12/2021 to 21/12/2021. The petitioner being the son has to attend the last rites of his deceased father.

This Court vide order dated 25/10/2021 passed in MCRC No. 7813/2021 rejected the bail application on merit.

Considering the facts for ad-interim bail and document annexed with the bail application along with certificate of death of father of the applicant, this Court find fit to release the applicant on interim bail. 5.
Accordingly, I.A. No. 01/2021 is allowed and it is directed that upon furnish a personal bond of Rs. 10,000/- with one surety to the satisfaction of the trial Court, the applicant be released on interim bail with immediate effect up to 26/12/2021. Thereafter the applicant shall surrender himself. 6.
In view of the allowing of I.A. No. 01/2021, counsel for the applicant does not press this bail application.

Accordingly, the bail application is disposed of. 8.
