(1) The accused/applicant has moved this third bail application under Section 439 of the Code of Criminal Procedure for releasing him on regular bail during trial in connection with Crime No. 9/2015 registered at Police Station Anti Corruption Bureau, Raipur for the offence punishable under Sections 11, 13(1)(d), 13(2) of the Prevention of Corruption Act, 1988 (for short 'the Act') and109, 120B, 409 and 420 of the Indian Penal Code. (2) The applicant's first bail application was dismissed on merits by order of this Court dated 16.07.2015 passed in M.Cr.C. No. 3185 of 2015.
(3) Thereafter, in the second bail application, the applicant has filed application for temporary bail, which was granted by this court for the limited period and thereafter he surrendered before the trial Court on 30th January, 2016 and since then he is in jail and now he has filed this third bail application for grant of bail. (2) Having heard learned counsel appearing for the parties, having regard to the facts & circumstances of the case, I do not find any good ground or change in circumstances to entertain this third bail application. Thus, the third bail application stands rejected.
