NAFR HIGH COURT OF CHHATTISGARH AT BILASPUR WPS No. 7137 of 2018 Mulchand Sonboir S/o Late Shri Ramjharokha Sonboir, Aged About 48 Years, Working As Revenue Inspector And Posted At Revenue Circle Kunni, Tahsil Lakhanpur, District Sarguja, Chhattisgarh. ---Petitioner

Versus

1. State Of Chhattisgarh, Through The Secretary, Department Of Revenue, Mahanadi Bhawan, Mantralaya, Naya Raipur, District Raipur, Chhattisgarh.

2. Director (Land Record), Atal Nagar, Raipur, District Raipur, Chhattisgarh.

---Respondents For petitioner :

Shri Ajay Shrivastava, Advocate.

For State :

Shri Chandresh Shrivastava, Panel Lawyer.

Hon'ble Shri Justice P. Sam Koshy Order on Board 29/10/2018 1.

The only grievance of the petitioner in the instant Writ Petition is for change of posting from his present place where the petitioner is working. 2.

The contention of the counsel for the petitioner is that, on 12/12/2017, the petitioner on promotion was transferred from Durg to Surguja and in compliance of the said order, he had assumed his duties and is continuing his service since then. He further submits that, due to personal inconvenience and certain family problems, the petitioner has moved a representation for a suitable change in the place of posting which is still pending consideration before the authorities. He further submits that, the respondent authorities meanwhile has decided the representation in respect

of 2 or 3 other employees who were also promoted along with the petitioner and sent to a different place.

3.

Given the aforesaid facts and circumstances of the case, knowing fully well that it is purely within the domain of the State Government to decide the place of posting as also the tenure of an officer is concerned, this Court only disposes off the Writ Petition with a direction that since the petitioner has made a representation, the authorities may consider and decide the same at the earliest preferably within an outer limit of 90 days from the date of receipt of certified copy of this order.

4.

The Writ Petition accordingly stands disposed off. Sd/- (P. Sam Koshy) Sumit JUDGE
