This is the second bail application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant who has been arrested in connection with Crime No. 383/2016 registered at Police Station- Chhavani, District Durg (C.G.) for the offence punishable under Section 304B, 498A/34 of Indian Penal Code. The first bail application was dismissed on merit on 15.02.2017 in MCRC No. 720 of 2017.

As per the prosecution case, one Rahnuma Bano committed suicide by hanging on 10.06.2016. She was married to the present applicant. It is alleged that after marriage, the applicant used to demand different amounts from different points of time from the deceased and also sold the entire gift items and subsequently again demanded Rs.1,00,000/-, therefore, she died an unnatural death within seven years of her marriage.

Learned counsel for the applicant would submit that till date the trial is not concluded, therefore, the applicant may be released on bail.

Per contra, learned State counsel opposes the prayer for grant of bail.

Considering the earlier bail rejection order dated 15.02.2017, which was dismissed on merit, I do not find any change of circumstances to reconsider the instant second bail application. 6.

Accordingly, the second bail application filed under Section 439 of Cr.P.C. is dismissed.
