1. The grievance of the petitioner is that the petitioner was posted at Sukma from 1993 to 1999 as Prahari in the Jail, which is a scheduled area. Subsequently, from 1999 to 2008 he was transferred to Jagdalpur, which is also a scheduled area and he was promoted to the post of Head Prahari. Subsequently again in 2008 he was transferred to Kanker and again the petitioner has been transferred to Jagdalpur. It is contended that as per the policy of the State, if a person has rendered service in scheduled area, he was entitled to be posted at non-scheduled area; however, in the present case, the petitioner is not considered and he has been repeatedly posted in the scheduled area. It is further contended that only 19 months of service is left, therefore, the petitioner may be allowed to make a representation to the respondent No.1 & 2, which may be directed to be decided.

Without going into merit of this case, at this stage, since earlier challenge to the transfer order has been dismissed by this Court on 17.09.2019, liberty is given to the petitioner to file a representation explaining all the details and if such representation is already filed, the respondents may take decision on the representation within an outer limit of 60 days from the date of presentation of a copy of this order.
