This is second bail application filed u/s 439 of the Code of Criminal Procedure for grant of bail to the applicant in connection with Crime No.49/2016 registered at Police Station Khursipar, Distt. Durg (C.G) for the offence punishable u/s 324, 307 of IPC and sections 25 & 27 of the Arms Act.
The first bail application was dismissed on 30.11.2016 as withdrawn.
Learned counself or the applicant submits that all the material witnesses have been examined and they have not supported the case of prosecution, therefore, the applicants may be enlarged on bail.
Per contra, learned State Counsel opposes the bail application.
No change of circumstances is pointed out by the learned counsel for the applicant.
It appears that the trial is at the fag end, therefore, at this stage, it is not proper for this Court to examine the entire case on merits.
Accordingly, this application is dismissed.
