1.
State of Chhattisgarh, through Police Station Kotwali, District Durg (C.G.) 2.
Harish Kumar Sinha, S/o Dayaram Sinha, aged about 45 years, R/o Kunwa Chowk, Pachripara, Durg, District Durg (C.G.) ... Respondents For Petitioner :
Mr. Ashok Patil, Advocate.
For Respondent No.1/State :
Ms. M. Asha, Panel Lawyer.
Hon'ble Shri Justice P. Sam Koshy Order on Board 05/09/2017 1.
The present Criminal Misc. Petition has been filed by the Petitioner seeking for withdrawal of the anticipatory bail granted to Respondent No.2 by this Court on 9.5.2017 in M.Cr.C.(A) No. 314 of 2017. 2.
The ground for cancellation of anticipatory bail granted to Respondent No.2 is that, the Respondent No.2 subsequent to his release on anticipatory bail was not cooperating with the prosecution and was trying to evade the investigation.
3.
This Court while entertaining the present petition had directed the State Counsel to ensure as to whether Respondent No.2 is cooperating with the prosecution in the investigation or not. Learned Counsel for the State, on receiving instructions from the police department, makes a statement that initially he was trying to avoid but subsequently he has started cooperating with the police authorities in the investigation. 4.
In view of the fact that Respondent No.2 has now started cooperating with the police authorities, this Court is of the opinion that the present Criminal Misc. Petition can be disposed of with a direction to the
-2police authorities to ensure that the investigation is concluded at the earliest and it is also expected that Respondent No.2 shall also, without breach of any of the conditions imposed while granting him anticipatory bail, render cooperation to the investigating agency. 5.
The Criminal Misc. Petition thus stands finally disposed of. Sd/- (P. Sam Koshy) /sharad/ Judge
