This is second bail application filed u/s 439 of the Code of Criminal Procedure for grant of bail to the applicant in connection with Crime No.101 of 2016 registered at P.L. Khadgawan, Distt. Korea for the offence punishable u/ss 489(A), (C) /34 of IPC.

As per the prosecution case, on 7.7.2016 on a raid being conducted from the possession of Lalit Kumar Sahu, Rs.15,000/- was recovered and from the room of the applicant fake currency notes of Rs.25,000/- were recovered along-with colour printer, scale, cello tape, pencil, paper cutter etc. subsequently, the applicant was arrested and from the applicant 10 notes of Rs.500/- denomination total Rs.5000/- were recovered which were fake.

Learned counsel for the applicant submits that the seizure witnesses have been examined and they have not supported the case of prosecution, therefore, the appellants may be enlarged on bail.

Perused the statements of witnesses. It appears that except the investigating officer, remaining witnesses have been examined.

The earlier bail application was dismissed on merit on 17.11.2016.

Considering the facts situation of the case, it would not be appropriate for this Court to give finding by

evaluating the statements of witnesses for consideration of bail at this stage.

Accordingly, this application is rejected.
