The applicant has preferred this Second Bail application filed under Section 439 of the Cr.P.C. for grant of regular bail as he is arrested in connection with crime No.34/2017 registered in Police outpost Jaalbandha, Police Station Khairagarh, District Rajnandgaon (CG) for the offence punishable under Sections 376, 294, 323 & 506 of the Indian Penal Code.

Albeit, while rejecting the first bail application, liberty was reserved in favour of the applicant to move afresh after examination of the prosecutrix; and now the prosecutrix has been examined and further considering the material available on record including the statement of

the prosecutrix, I am not persuaded to take a different view of the matter.

Accordingly, the bail application fails and is hereby dismissed. However, the trial Court is directed to expedite the trial and conclude the same at the earliest.
