(2) This is third bail application filed under Section 438 of the Cr.P.C. for grant of anticipatory bail to the applicant, who has been arrested in connection with Crime No.241/2014 registered at Police Station Hirri, District Bilaspur for the offence punishable under Sections 304-B/34 of IPC.
(3) The two bail applications of the applicant were dismissed as withdrawn by order of this Court dated 11.02.2015 passed in M.Cr.C.A. No.1332/2014 and order dated 07.07.2016 passed in M.Cr.C.A. No.512/2016.
(4) Learned counsel appearing for the applicant would submit that the other co-accused persons have already been acquitted by the trial Court vide judgment dated 11.05.2017 and therefore, the applicant may be released on bail.
(5) On the other hand, learned counsel for the State would oppose the prayer for grant of bail.
(6) I have heard learned counsel appearing for the parties. (7) Taking into consideration the facts and circumstances of the case, nature and gravity of the offence and the fact remains that the applicant is absconding since 06.10.2014, I am not inclined to grant anticipatory bail to the applicant. Consequently, the bail application is rejected.
