Heard.

This is third bail application filed u/s 439 of the Code of Criminal Procedure for grant of bail to the applicant in connection with Crime No.167 of 2016 registered at P.S. Gidhouri, Distt. Balodobajar-Bhatapara for the offence punishable u/s 304-B/34 of IPC.

As per the prosecution case, one Akshay Kumari was married to Shesh Narain in April, 2015. It is alleged that on 24.02.2016 she died in unnatural circumstances in her house due to burn injuries and before that she was subjected to cruelty for not bringing the motorcycle and cash and she was physically assaulted. The merg was reported to be intimated by Ganesh Ram whereby it is stated that the deceased died due to short circuit. Subsequently, on an inquiry, it was revealed that the applicant and co-accused Ganesh Ram who is father in law alongwith others have demanded dowry and treated the deceased with cruelty for demand of dowry, consequently, she died in unnatural circumstances. Learned counsel for the applicant submits that the complainant has been examined, therefore, the applicant may be enlarged on bail at this stage.

Per contra, learned State Counsel opposes the bail application.

Considering the fact that the earlier bail application was rejected on 22.06.2017, I do not find any change of circumstances to reconsider the bail again within a short span of time.
