The dispute raised in the present Writ Petition is that, the petitioner initially inadvertently was not granted the promotion from the post of Assistant Teacher (Panchayat) to the post of Teacher Panchayat when his juniors were promoted with effect from 16/09/2009. 2.

Subsequently, on a representation being made by the petitioner, the respondent No.2 had granted the benefit of retrospective promotion to the petitioner vide Annexure-P/4 dated 23/01/2017 and the promotion was given effect from the date his juniors were promoted i.e. from 16/09/2009 with consequential benefits.

The sole grievance of the petitioner is that, though the respondent No.2 has taken a decision, but till date the order has not been complied with to the extent of granting of the monetary benefits which are to be paid on the promoted post with effect from 16/09/2009.

Given the said limited grievance, this Court is of the opinion that, no fruitful purpose would be served in keeping the Writ Petition pending, rather ends of justice would meet if the Writ Petition is dispose off with a direction to the respondent No.2 to ensure that the order Annexure-P/4 dated 23/01/2017 is complied with in its letter and spirit at the earliest preferably within a period of 90 days from the date of receipt of certified copy of this order.
