1. This is the second bail application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant who has been arrested on 11-7-2016 in connection with Crime No. 83 of 2015, registered at Police Station Gidhori, District Balodabazar Bhatapara (CG) for the offence punishable under Sections 379, 407, 420, 120(B) /34 of the IPC and Sections 3 & 7 of the Essential Commodities Act, 1955.
2. The first bail application bearing M.Cr.C. No.5376/2016 was dismissed on merits on14.09.2016.
3. On the last date of hearing parties were directed to verify as to what is the status of the trial. For that learned State counsel submits that out of 11 witnesses 10 witnesses have been examined. Therefore, considering
the fact that the trial is at the fag end, I do not find it necessary to decide the case on merits as it will adversely affect the case. Accordingly, the bail application is dismissed.
