1. The present contempt petition has been filed alleging dis-obedience of this order dated 26.08.2019 passed in WPS No. 6439/2019, interim order was granted by this Court directing the respondent No. 2 to keep two post vacant from the unreserved category by the Department till further orders.

2. On the previous date, since respondent No. 2 inspite of services did not appear, this Court had directed for personal presence of the respondent No. 2 who is present before this Court today. The respondent No. 2-Shri H.R. Dubey, Under Secretary, Urban Administration and Development Department has filed a reply supported with Affidavit categorically stating that as per interim order of this Court two post of CMO in the unreserved category has been

-2kept vacant to be considered subject to the outcome of the writ petition No. 6439/2019.

3. This Court had specifically put a query to Shri H. R. Dubey in this regard, he submits that he has full knowledge of the same so far as two posts of CMO lying vacant in the unreserved category is concerned.

4. Given the said statement by the respondent No. 2 on oath, this Court is of the opinion that there does not seem to be any violation of the order dated 26.08.2019.

5. The contempt petition stands disposed of. The personal presence of the respondent No. 2 stands dispensed with and he is discharged from the contempt proceedings. Sd/- (P. Sam Koshy) Judge Jyotijha
