1. This is the second bail application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant who has been arrested in connection with Crime No.205/2016 registered at Police StationNandini, District Durg (C.G.) for the offence punishable under Section 20(B) of NDPS Act.

2. As per the prosecution case, on a secret information received on 31.07.2016, from the Car bearing No.C.G.04-ZD-2636, total 16 Kg of Cannabis were recovered from the possession of the present applicant, who was one of the inmate of the Car.

3. Learned counsel for the applicant submits that the applicant has been falsely implicated and the seizure witnesses have not supported the case of the prosecution, therefore, the applicant may be released on bail.

4. Per contra, learned State counsel opposes the prayer for grant of bail.

5. Perused the case diary and the seizure. The statement of I.O. is necessary in this case which is yet to be examined, I do not find any change in the circumstances.

6. Accordingly, the bail application filed under Section 439 of Cr.P.C. is dismissed.
