Hon'ble Shri Justice Goutam Bhaduri Order on Board -10-2019

1. The challenge in the present petition is to the order dated 13th August, 2019 (Annexure P-1) whereby the petitioner who is posted at P.H.No.28, Pali, Tahsil Kartala, District Korba has been transferred to District Bilaspur.

2. The contention of the petitioner is that he is working as Patwari and as per the Land Revenue Code, the services of the Patwari cannot be transferred to outside the district and accordingly the seniority and promotion granted to a Patwari is maintained districtwise. He submits that transferring the petitioner out of the

district would affect the seniority and further promotion of the petitioner, therefore, the impugned order may be set aside.

3. Given the said facts, let the petitioner make a detailed representation to the respondents within a period of 10 days from the date of receipt of the copy of this order and the respondents in turn shall consider and decide the same within a further period of 45 days from the date of receipt of the representation.

4. Meanwhile, the effect and operation of the impugned order shall remain stayed so far as it relates to the petitioner.

5. With the aforesaid observations, the present petition stands disposed off.
