The present application under Section 439 of CrPC for grant of bail has been filed by the Applicant who is in jail since 14.2.2017 in connection with Crime No. 88 of 2017, registered at Police Station Khamtarai, Raipur, for the offence punishable under Section 420/34 of IPC. 2.

The present is a repeat bail application as the earlier application for grant of bail was rejected by this Court on 14.6.2014 on merits. 3.

The present application has been filed within a short span of two months' time and that the only ground which has been raised in the instant application is that the Applicant is said to have remained in custody for a period of more than six months.

The earlier bail application having been rejected on merits on 14.6.2017, i.e., barely two months' ago, this Court does not find any strong case made out for reconsidering the Applicant's case for grant of bail in a short span of time. Further, the Applicant also has not been able to establish any substantial change in circumstances or development that has

-2arisen which could be taken note of by this Court for consideration of grant of bail to the Applicant.

For the aforesaid reasons, this Court is not inclined to grant bail to the Applicant. The bail application stands accordingly rejected. Sd/- (P. Sam Koshy) /sharad/ Judge
