This is the second bail application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant who has been arrested in connection with Crime No.42/2015 registered at Police Station- Devbhog, District Gariyaband (C.G.) for the offence punishable under Section 409, 420, 423, 467, 468, 471, 120(B) of Indian Penal Code. The first bail application was dismissed as withdrawn on 09.01.2017 in MCRC No.8275/2016. 2.
Case of the prosecution, in brief, is that the applicant while was working in the Cooperative Society Jhakharpara by manipulation in the Computer and weighment purchased the paddy and subsequently shortage was found, which was worth Rs.4,01,96,145/-.

Learned counsel for the applicant would submit that the trial has not been concluded till date and the applicant is in jail since 24.10.2016, therefore, the applicant may be released on bail.

Per contra, learned State counsel opposes the prayer for grant of bail.

Perused the earlier bail dismissal order dated 09.01.2017. The bail application was dismissed as withdrawn and there was no liberty given in such order. Consequently, I do not find any change of circumstances to reconsider the instant second bail application. 6.
