This is third bail application for grant of temporary bail to the applicant for a limited period of 30 days.
The first bail application was dismissed on 6/12/2016 vide M.Cr.C. No.6463 of 2016 and second bail application was dismissed on 7/07/2017 vide M.Cr.C. No.2898 of 2017.
The applicant has preferred this application for grant of temporary bail as he is arrested in connection with Crime No. 238/2016 registered in Police Station City Kotwali, Raipur (CG) for offence punishable under sections 420, 467, 468, 471 and 511 of Indian Penal Code.
Present bail application has been moved on the ground that the applicant has to undergo certain operation for his eye and MRI was prescribed and he requires better treatment and certain documents were filed.
Learned State counsel was directed to verify the same. Learned State counsel submits that applicant was examined and MRI
Brain + Orbit (P+C) conducted by three doctors namely Dr. Nishant, Dr. Kavita and Dr. Sanjay of Pt. J.N.M. Medical College & Dr.B.R. Ambedkar Memorial Hospital Raipur. As per MRI report no significant abnormality is seen. Copy of the same placed for perusal of the court. Learned State counsel is directed to place photo copy of the same. In view of the medical report, I am not inclined to grant temporary bail to the applicant as it appears that no significant abnormality exist to grant the bail on temporary grounds.
