This is an application filed under Section 439 of the Cr.P.C. for grant of regular bail to the applicant, who has been arrested in connection with Crime No.07/2017 registered in Police Station Kondagaon (CG) for the offence punishable under Section 20b(ii)B of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short 'the NDPS Act').

Learned counsel for the applicant submits that the applicant has been arrested on 24.02.2017, after investigation, Police has filed charge sheet before Special Judge under the NDPS Act, Kondagaon, but learned counsel for the applicant is not aware of the Special Criminal Case number. It is submitted on behalf of the applicant that when the applicant was arrested at that time the ganja was not seized from him, hence he may be released on bail.

Per contra, learned counsel for the State opposed the arguments advanced on behalf of the applicant. 5.
Perused the entire material.

On due consideration of the quantity of ganja i.e. 77.057 kg seized from the applicant and also considering the other facts surfaced against the applicant, I am not inclined to grant bail to the applicant.

Accordingly, the bail application filed under Section 439 of the Cr.P.C. is hereby dismissed.
