1. This is the third bail application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant who has been arrested on 09-08-2016 in connection with Crime No. 161/2016 registered at Police Station Mahasamund, Distt. Mahasamund (C.G.) for the offence punishable under Sections 420, 467, 468 & 471/34 of the I.P.C.

2. Learned counsel for the applicant would submit that the applicant has paid his part of the amount which was alleged to have been taken from the complainant Chetan Kumar Thakur.

3. Shri Praveen Dhurandhar, learned counsel for the complainant also do not dispute the same and submits that the complainant has entered into compromise with the applicant.

4. Considering the above submission made by both the parties i.e. the applicant and the complainant and the fact that the applicant is in jail since 09.08.2016, I am inclined to release the applicant on bail.

5. Accordingly, the bail application is allowed and the applicant is directed to be released on bail on his executing a personal bond in sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
