1. Heard.

2. The applicant has preferred this application filed under Section 439 of the Cr.P.C. for grant of regular bail as he is arrested in connection with crime No.9 6/2013 registered in Police Station- Surajpur, District Surajpur (CG) for the offence punishable under Section 20(b)(ii)(B) of the Narcotic Drugs and Psychotropic Substances Act, 19 85.

3. The applicant was found in possession of 2.6 kgs. of contraband Ganja on a search being made of his belongings at

the time when he was waiting at the Bus Stand of Surajpur.

4. The applicant was earlier allowed bail vide order dated - 52013 passed in M.Cr.C.No.1842 of 2013, however, he has again been arrested upon issuance of nonbailable warrant for his failure to appear before the trial Court during course of trial.

5. Since after his rearrest on 10- - 2018 the applicant is now in jail for more than 4 months, therefore, considering all aspects of the matter, this Court is inclined to release him on bail. Accordingly, the application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.50,000/- with two local sureties for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
