Counsel for the petitioner submits that Cr.M.P. No.854/2016 between the parties was pending before the Court and listed on 13.07.2017, on that date, petition was dismissed on the prayer made by the counsel to withdraw that petition.

It is submitted by the counsel for the petitioner that he was mistaken by registration number of Cr.M.P. as he was instructed to withdraw Cr.M.P. No.319/2017 only, which was listed on a later date, then it came to his

Page No.2 knowledge that on account of his mistake, Cr.M.P. No.854/2016 was withdrawn and order of dismissal was passed by this Court. 3.

Counsel for the petitioner submits that he takes the responsibility that it is because of his mistake, this petition was dismissed and has prayed for restoration so that the petitioner may not suffer on account of the mistake committed on his part.

Considering the submission made, the petition is allowed. Cr.M.P. No.854/2016 is restored to its original number. 5.
